For the linguistically challenged the title means “surprised much?” Anyone who is surprised by either the CIT’s(commander in thief) pick for Supreme Court Justice or his administrations draconian efforts to smother any and all criticism of Sotomayor has truly been living under a rock the size of Mt. St. Helen’s. Apparently you must be “very careful” when talking about this woman. Amazingly she must not be subjected to the same infamous grilling that characterized the Bork or Thomas hearing. It seems that the Senate Judiciary Committee need not even bother to come in and interview her, they can simply call in their “Aye” votes from their vacation retreats in the Hamptons or where ever it is rich white people go for fun.
Let’s get a little taste of what we have to look forward to in the next 30+ years, because as I’m sure you are aware of there is no firing of Chief Justices.
Whether born from experience or inherent physiological or cultural differences, a possibility I abhor less or discount less than my colleague Judge Cedarbaum, our gender and national origins may and will make a difference in our judging. Justice O’Connor has often been cited as saying that a wise old man and wise old woman will reach the same conclusion in deciding cases. I am not so sure Justice O’Connor is the author of that line since Professor Resnik attributes that line to Supreme Court Justice Coyle. I am also not so sure that I agree with the statement. First, as Professor Martha Minnow has noted, there can never be a universal definition of wise. Second, I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn’t lived that life.
Good to know. I am sure that by this standard she will recuse use her self from any and all cases to do with anything she doesn’t have experience with personally. Any cases to do with religious issues that are not of a Catholic flavor, any cases involving “white men” “white women” or “white children”, blacks, asians, Middle easterners et al should be off limits as well as anything to do with technology, medicine, geriatrics …….the list goes on and on. If she hasn’t had experience in these things how can she hope to pass judgement on them, according to, of course, her statement above.
Never mind that a Chief Justice should be impartial until they have heard the facts of the matter, never mind that it is NOT their job to be advocates, revisionists, constructionists or panderers. They should not be beholden to any political person, institution or cause. Like journalists (ha ha) they should strive to be objective in their job and like most journalist fail miserably.
This woman is the Dolores Umbridge of the current administration. If you don’t know who that is ask any Harry Potter fan. They’ll give you a pretty fair description of the current nominee.
I hate it when life imitates are. I hate it more when so few people even bother to notice.
